Securities industry grows tremendously in the world and in Tanzania now. Its growth is much more associated with development of science and technology as well as global economy interaction. Its growth has both prospects and challenges. Without effective legal and institutional foundations, its potentials will not be realised.

Hence, this book intends to examine the legal and practical recognition, protection and enforcement of the right to invest in the securities industry in Tanzania as well as to determine the effectiveness of the mechanisms towards recognition, protection and enforcement of the right to invest in the securities.

It is revealed in this book that securities investment is little known area to most people of Tanzania. It is known to some big companies and not individual persons which makes participation to the sector seem to be to it is right by the companies with large capital. However, to some extent the securities laws and institutions recognise, protect and enforce the right to invest in the securities industry in the country. Nevertheless, there are weaknesses within the laws and institutions in making sure the sector reveals its potentials and opportunities to all people in the country.

The author makes recommendation such as provision of securities investment education to Tanzanians and few amendments to some laws such as sections 54(1), 135 (1) and 136 (1) of the Capital Markets and Securities Act to mention but few.

Organisation

This book surrounds five chapters. Each chapter encompasses relevant and specific information and theme. Chapter one entails general introduction as far as the subject matter is concerned. It is general introduction relating to the recognition, protection and enforcement of the right to invest in the securities industry. It explains, enlightens and justifies the undertaking of the study.

Chapter two involves conceptual and theoretical undertakings related with the study. It makes the reader understand the concepts and their rationales that establishes this book. It lays conceptual understanding of the securities industry and its laws. It encloses the conceptualisations of the basic terms and their roles and or functions. The current overview of the securities industry and its laws in the country compared to what has transpiring before features within the chapter as well.

Chapter three embroils the legal and institutional analysis. It deals with exploration of the legal and institutional set ups dealing with the investment in the securities industry in the country. It implicates analysis of the securities laws that recognises, protects and enforces the right to invest in the securities industry. Moreover, it spells out the institutional responsible for regulation of the securities sector to understand the frameworks and effectiveness.

Chapter four engrosses the analysis as far as recognition, protection and enforcement of the right to invest in the securities industry in Tanzania. This where ideas, views and comments are presented especially from what stakeholders or respondents, interviewees are saying on the securities sector. It presents the findings and what do they mean or imply basing on the legal point of view.

Chapter five embraces the conclusion and recommendations. This part settles on the securities industry and problem identified. However, it puts forward the measures to be taken to make sure the sector is effective for every stakeholder to benefit justifiably.
