The framers of the U.S. Constitution were very specific about what duties were to be performed by the federal government and which were to be performed by the respective state governments. In Nullification, Woods argues the federal government is like a runaway train and is now starting to enact legislation in areas which the Constitution specified should be left to state governments to decide. The Constitution anticipates this possibility and provides a mechanism called “Nullification” to deal with it. Nullification means states have the capacity to declare a federal law as being unconstitutional and therefore void and of no effect. Nullification has always been intended as a shield between the people of a state and unconstitutional laws from the federal government. Woods suggests it is now time for states to become more proactive in using nullification to stop the federal government from swaying into legislative areas where it has no mandate to act. The federal government will never limit its reach on its own – it’s time for the states to act as a meaningful counterbalance to federal power in the way the Constitution prescribes.
Thomas E. Woods, Jr. is a senior fellow at the Ludwig von Mises Institute in Auburn, Alabama. He is the author of ten books including The Politically Incorrect Guide to American History and Meltdown. He is a contributor to numerous periodicals, a frequent media commentator and contributing editor of The American Conservative magazine.
For a number of years the prevailing and bipartisan view in the United States has been that there are no real constitutional limitations on what the federal government is authorized to do. Accordingly, the government has been engaged in regulating a wide and diverse range of activities which has, in turn, meant the central government has grown at a worrying rate. Today, the accepted wisdom is there are no programs or even activities which fall outside the jurisdiction of the federal government.
