Greenburg also examines the selection process from inside the White House, revealing the sometimes bizarre missteps and strokes of brilliance that have led to decisions made by Presidents Reagan, H.W. Bush, Clinton, and G.W. Bush.

About the Author

Jan Crawford Greenburg is a law and politics correspondent for ABC News and she was previously a Supreme Court analyst for News-Hour with Jim Lehrer on PBS and Face the Nation on CBS. She has covered the Supreme Court for 12 years.

In 2004, at the same time Justice Rehnquist’s health began to deteriorate, Justice O’Connor reluctantly began planning her own departure to care for her ailing husband. O’Connor and Rehnquist were close friends, having known each other for more than 50 years since their days at Stanford. When she told Rehnquist of her need to leave the court after another year, he said, “We don’t need two vacancies,” and told her he would stay another year.

O’Connor was caught off guard by Rehnquist’s implication that she retire now or be prepared to serve two more years, longer than she wanted. Her opinions had determined the direction of the Court, reshaped American culture, and preserved the constitutional right to an abortion, but it was Rehnquist who was deciding her fate. But O’Connor knew what she had to do. Her husband, John, had supported her for so long. It was her turn to support him, so she deferred to her old friend and chief. This decision would ultimately lead to a change in the Supreme Court that would alter the direction of America.
