Book Abstract

The Constitution originally granted the federal government only limited, enumerated powers, but every administration since our country’s inception has seized increasingly greater powers. Napolitano outlines the history of the federal government’s encroachments on our constitutional rights, discussing Supreme Court cases, Congressional acts and administration policies. Especially in a post-9/11 world characterized by the excesses of the USA PATRIOT Act, the federal government admits no limitations on its powers and holds our constitutionally-protected freedoms in contempt.

About the Author

Judge Andrew P. Napolitano served on the New Jersey Superior Court from 1985 to 1997. He is currently the senior judicial analyst for Fox News and he also appears regularly on The O’Reilly Factor and Fox and Friends. He is the author of Constitutional Chaos and his writing on current affairs also appears in The New York Times, The Wall Street Journal and many other newspapers and journals. A graduate of Notre Dame University Law School and Princeton University, he has taught law for 11 years at Seton Hill University Law School.

Introduction

The roots of debate over the Constitution lie in the disparity between two views of government. One view, shared by our country’s founders, believes in the primacy of Natural Law, which derives from God, and to which government is subordinate. Our natural rights and freedom derive from being human. “Under natural law, the only legitimate goal of government is to secure liberty.” Under this view, the Bill of Rights does not grant rights to the people, but in fact restricts the government from trampling on rights that already naturally belong to them. It also compels government to actively defend these rights. Counter to this view is the positivist position, which holds that laws must be written down and the government has supreme power, creating rights and granting rights to the people. The problem with this position is that it also grants government the power to take rights away. Under the sway of positivism today, “the government violates the law while busily passing more legislation to abridge our liberties. The government recognizes no constraints on its power and enacts whatever laws it wishes.”
